Terms of Service

1. Acceptance of Terms

By accessing or using the MyAmbits application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time. Your continued use of the Service following any changes constitutes acceptance of those changes.

2. Description of Service

MyAmbits is a location-based mobile and web application that provides:

• Nearby place discovery and recommendations
• Ambit AI-powered assistance
• Social features including friend discovery and proximity alerts
• Safety features including "Walk Me Home" tracking
• Real-time weather and contextual information
• Emergency contact management

3. User Accounts

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use the Service
• One person may not maintain more than one account
• You are responsible for all activity that occurs under your account

4. Location Services

The Service relies heavily on location data. By using the Service, you acknowledge that:

• Location accuracy depends on your device's GPS capabilities and environmental conditions
• We are not responsible for inaccuracies in location data
• You may disable location sharing at any time, but certain features will not function without it
• When using "Walk Me Home," your location is shared with your designated emergency contacts
• Friend proximity features require active location sharing

5. Ambit

The Ambit feature uses artificial intelligence to provide recommendations and assistance. You acknowledge that:

• AI responses are generated by third-party AI models and may not always be accurate
• Recommendations are informational and do not constitute professional advice
• Place recommendations are based on available data and may not reflect current conditions
• Session limits apply to AI conversations (currently 20 messages per session)
• We are not liable for actions taken based on AI recommendations

6. Safety Features Disclaimer

The "Walk Me Home" and SOS features are provided as supplementary safety tools. They are not a substitute for emergency services.

• In case of emergency, always call your local emergency number (e.g., 911, 112)
• We do not guarantee the delivery of notifications to emergency contacts
• Location tracking may be affected by network connectivity or device limitations
• We are not liable for any harm resulting from reliance on these safety features
• Emergency service information (hospitals, police stations) is sourced from third-party data and may not be current

7. SMS / Text Messaging Terms

MyAmbits offers SMS-based safety notifications as part of its SOS and "Walk Me Home" features. By adding a contact's phone number as an emergency or trusted contact in the app, you confirm you have that person's permission to receive safety-related text messages from MyAmbits on your behalf.

Opt-in / confirmation. When you add someone as an emergency contact, MyAmbits sends that person a one-time confirmation text message identifying who added them and explaining they will receive safety alerts only when you trigger an SOS or Walk Me Home event. That message includes instructions to reply STOP to opt out or HELP for help.

When you trigger an SOS alert or a "Walk Me Home" session, MyAmbits sends text messages to your designated contacts containing your name, safety status, and location.

• Message frequency. Messages are sent only in response to user-triggered safety events (SOS or Walk Me Home). Frequency varies with your use of the safety features.
• Opt-out (STOP). Recipients may opt out at any time by replying STOP to any message, after which no further messages are sent.
• Help (HELP). Reply HELP to any message for support information, or contact support@myambits.com.
• Message & data rates. Message and data rates may apply, charged by the recipient's mobile carrier.
• No marketing. MyAmbits does not use SMS for marketing or promotional purposes.
• No third-party sharing. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Mobile carriers are not liable for delayed or undelivered messages, and MyAmbits does not guarantee delivery — SMS should not be relied upon as the sole means of emergency communication; in a life-threatening emergency, always call 911 or your local emergency number. 8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Harass, stalk, or harm other users
• Use the Service to track someone without their consent
• Create false or misleading profiles
• Attempt to access other users' accounts or data
• Interfere with or disrupt the Service or its infrastructure
• Reverse-engineer, decompile, or disassemble the Service
• Use automated systems or bots to interact with the Service
• Abuse the Ambit feature or attempt to manipulate its outputs

9. Intellectual Property

The Service and its original content (excluding user-generated content), features, and functionality are owned by MyAmbits and are protected by international copyright, trademark, and other intellectual property laws. The MyAmbits name, logo, and all related names, logos, product and service names are trademarks of MyAmbits.

10. Third-Party Services

The Service integrates with third-party services including Google Maps, Firebase, and Anthropic's AI. Your use of these integrated services is subject to their respective terms and conditions. We are not responsible for the practices or content of third-party services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MyAmbits and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, resulting from:

• Your use of or inability to use the Service
• Any inaccuracy in location data or place recommendations
• Unauthorized access to or alteration of your data
• Actions or omissions of third-party service providers
• Any other matter related to the Service

12. Indemnification

You agree to indemnify, defend, and hold harmless MyAmbits, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time through the app settings.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in the Commonwealth of Virginia.
